Abstract
The success of ride-sharing services in various countries raises the question of whether this model can be adapted successfully by Indonesian companies, given the unique market dynamics, distinctive user needs, and diverse regulatory challenges. In the Minister of Transportation Regulation Number 118 of 2018, it
was found that the bureaucracy related to the implementation of the ride-sharing service business in Indonesia experienced several significant obstacles. The procedures and requirements that must be complied with by ride-sharing service providers are sometimes considered too complicated, lengthy, and ineffective by many related parties. Research problems are to understand the existing legal challenges in regulating ride-sharing services in Indonesia within the framework of transportation law, using a qualitative doctrinal legal research methodology. A comparative approach is used to analyze the Minister of Transportation Regulation Number 118 of 2018 and Minister of Transportation Regulation Number 108. To address these challenges, this research suggests the introduction of more flexible fare determination mechanisms, re-evaluating the requirements for vehicle storage pools, developing and disseminating clear guidelines regarding the time limits for signing permits, and implementing strict regulations to protect customer privacy related to in-vehicle video recordings. This thesis recommends simplifying the bureaucratic processes involved in operating ride-sharing services to encourage economic growth. These findings have significant implications for future regulatory
policies and pave the way for new research in the field of transportation law in Indonesia.
