Israel's war with Palestine has been going on for a very long time and has claimed many victims. The border issue between Israel and Palestine means the war cannot be resolved because both sides claim the same land. Palestine and Israel both claim ownership of the same territory. Exactly on October 7 2023, the Palestinian militant group carried out a massive invasion attack into Israeli territory suddenly, which this attack was called the "Al-Aqsa Flood War" which aimed to ease the embargo on the Gaza Strip, freeing the territory from Israeli occupation. This attack carried out by Hamas cannot be justified according to Article 51 of the UN Charter because Hamas does not represent Palestine as the country that carried out this attack. In response to the attack, Israel carried out massive retaliation measures with the aim of protecting its citizens and the sovereignty of its country. However, many people consider that this attack is a form of genocide carried out by Israel against Palestine. In this case, Israel denied the accusation because Israel argued that it was only carrying out retaliation for the Hamas attack on October 7 2023. In this case, there is International Law, Article 51 of the United Nations Charter and the Convention on the Prevention and Punishment of the Crime of Genocide of 1948 which regulate this matter. This research uses a juridical – normative research methodology. In short, normative juridical research discusses doctrine or principles in legal science. The research results from this thesis are that the reprisal action carried out by Israel was valid according to Article 51 of the United Nations Charter, but in this case Israel carried out acts of genocide according to the Convention on the Prevention and Punishment of the Crime of Genocide of 1948.
