Abstract

Air transportation is a reliable means of connecting a number of cities in remote parts of the country which are quite far away. The transport of corpses by air is governed by the International and National Aviation Regulation. This research aims to discuss the legal framework surrounding the carriage of corpses by air, focusing
on airline company responsibilities. This research will examine the Indonesian Law in arranging corpse as cargo and check the form of legal liability from the airline company. The method used in this research is legal research with a scientific approach, statutory approach, and comparative approach utilizing descriptive analytical research specification using secondary consisting of primary legal materials, secondary legal materials and
tertiary legal materials. These sources are utilized for qualitative analysis to develop arguments, theories, or concepts in addressing the issues. Based on the research that has been done, it can be found that, the classification has significant implications for the legal protection of the sender of the bodies in the event of loss or damage to the bodies. This study is significant as it addresses the need for a more appropriate legal framework for the transport of corpses by air. This circumstance has led in issues such as uncertainty about the inappropriate position of the corpses as well as disparities in the amount of compensation in the event of loss or damage to the bodies in charge of handling human remains by air transportation.
