Abstract
Law Number 22 of 2009 concerning Road Traffic and Transportation is an important foundation in transportation regulations in Indonesia, but its implementation still faces obstacles. The problems studied are related to the security and safety service standards of public transportation based on Law Number 22 of 2009 concerning Road Traffic and Transportation, as well as legal analysis of the case of the Study Tour Tourism Bus accident in Subang based on Article 141 Paragraph (1) of Law Number 22 of 2009 concerning Road Traffic and Transportation. The research method used is normative research that qualitatively analyzes the case of a tour tourism bus accident in Subang with a literature study.
The results of the study showed that the accident that befell the group of SMK Lingga Kencana Depok in Subang revealed a number of violations of the LLAJ Law.
The buses do not meet the established safety standards, but they also operate without valid route permits and expired periodic test status. Drivers as key role holders in passenger safety must have adequate qualifications and be equipped with training in dealing with emergency situations. Meanwhile, bus companies are responsible for ensuring their fleet is safe and compliant with all applicable technical and legal requirements. Based on Articles 191 and 192 of the Law, bus owners or managers have a legal obligation to provide compensation to accident victims as carriers. The case highlights the need for stricter law enforcement and more intensive supervision to ensure compliance with safety regulations in public transportation operations.
