Abstract
This thesis investigates Indonesia's management of state sovereignty over its natural resources and intergenerational equity in sea sand extraction within the context of international law. It addresses two primary questions: firstly, how Indonesia can effectively balance state sovereignty with intergenerational equity in sea sand extraction; and secondly, whether Indonesian Government Regulation No. 26 of 2023 aligns with international environmental accountability standards. Employing a juridical-normative approach by legal positivism, the research conducts a descriptive analysis of relevant literature and international agreements. The findings underscore the importance of sustainable development for economic growth, environmental conservation, and social well-being, amidst the challenges of sea sand extraction. Thus, Indonesia must strike a balance between sovereignty over natural resources and intergenerational equity to ensure sustainable resource management and environmental protection. Despite normative
alignment with international environmental accountability principles, practical implementation of Government Regulation No. 26 of 2023 presents contradictions, including concerns about environmental degradation and habitat loss.
Recommendations emphasize the need for a comprehensive approach integrating scientific knowledge, community engagement, and international cooperation to address the complexities of sea sand extraction. Clarifying regulations and enhancing stakeholder engagement are proposed to align with international environmental accountability standards and mitigate adverse impacts on ecosystems and communities.
