Failure to fulfill the obligation to provide protection to ambassadors of other countries by a country can lead to state responsibility for that country. This research aims to determine regarding in which situation the state responsibility need to be fulfil by a state in Diplomatic Relations field. This research used the murder case of Luca Attanasio which is the Italian Ambassador to the Democratic Republic of the Congo as the research case. The use of this case aims to find out the responsible party of the murder case of Italian ambassador and the form of responsibility that can be performed by responsible party for its failure to comply with the Convention. This research uses normative research methods, so the researcher will use secondary data which consists of primary legal material and secondary legal material. The legal material is obtained either through the web or books from the library. This research is aims to obtain advice on the problems contained in this research. All data obtained will be analyzed using Qualitative Analysis Method which will present the data that has been analyzed in written form. The results of the research show that Congo is the responsible party so DRC need to carry out state responsibility. Because the case is still ongoing, there are suggestions that can be used in order to compensate for the losses suffered by Italy and to restore diplomatic relations between Democratic Republic of the Congo and Italy back to normal.
