The airline requires financing to support the aviation sector as a capital-intensive and high-technology industry in its procurement and all of the financing is based on the Law Number 1 Year 2009 regarding Aviation. As with all business sector, it must require collateral to prevent the parties from defaulting. Article 71 on Law Number 1 Year 2009 said that “Aircraft objects can be encumbered with international interests arising from agreements granting rights collateral, conditional title agreement, and/or lease agreement, and/or lease agreement.” Since the rights of each party are given preference or precedence over ordinary debtors, and the pledged assets are under the debtor's control, the proceeds from asset operation are a form of term payment on the financing. Fiduciary is defined as a method of passing property rights from the owner (debtor) to the creditor based on the existence of a principal agreement (debt and credit agreement), but what is handed over is only legally binding and solely owned by the creditor. The author's intention for writing the thesis on aircraft financing is to examine and learn about aircraft financing practices in Indonesia in order to increase the reading interest of ordinary people, particularly in aircraft financing schemes that are slightly known with juridical analytical descriptive analysis as a specification in this thesis.
