Abstract

Penelitian ini dilatarbelakangi oleh posisi strategis komoditas timah (Sn) dalam sistem energi modern serta kebutuhan penguatan ketahanan energi-mineral nasional melalui kebijakan hilirisasi. Dalam konteks tersebut, penetapan hilirisasi pertimahan sebagai bagian dari Proyek Strategis Nasional (PSN) pada PT Timah Tbk menjadi isu yang memerlukan kajian hukum dan kebijakan secara komprehensif. Rumusan masalah dalam penelitian ini meliputi: (1) apa yang menjadi dasar dan urgensi penetapan kebijakan hilirisasi pertimahan sebagai bagian dari PSN pada PT Timah Tbk; dan (2) bagaimana reformulasi kebijakan hilirisasi pertimahan dalam kerangka PSN. Penelitian ini menggunakan metode kualitatif dengan metode studi literatur (library research) dan pendekatan deskriptif-analitis. Data diperoleh melalui penelaahan peraturan perundang-undangan, dokumen kebijakan, serta literatur ilmiah yang relevan dengan sektor pertambangan, industri, dan energi. Analisis dilakukan untuk menganalisis keterkaitan antara kebijakan hilirisasi pertimahan, kerangka PSN, dan konsep ketahanan energi-mineral nasional.
Hasil penelitian menunjukkan bahwa penetapan hilirisasi pertimahan dalam kerangka PSN memiliki dasar konstitusional dan yuridis yang kuat, khususnya merujuk pada Pasal 33 UUD NRI 1945 serta peraturan perundang-undangan di bidang pertambangan dan PSN. Secara substantif, hilirisasi pertimahan memiliki urgensi strategis karena mampu meningkatkan nilai tambah domestik, menjamin ketersediaan material konduktif bagi industri energi, serta memperkuat struktur industri berbasis mineral kritis. Dalam aspek kebijakan, perumusan hilirisasi pertimahan perlu diarahkan pada penguatan rantai nilai hulu-hilir yang terintegrasi dengan industri energi hal tersebut dikarenakan masih ditemukan beberapa temuan antara lain: disharmoni regulasi, ketidakpastian perizinan, serta keterbatasan pasokan bahan baku. Evaluasi kebijakan menunjukkan perlunya reformulasi yang menekankan harmonisasi regulasi, kepastian hukum, serta optimalisasi pemanfaatan mineral ikutan untuk mendukung ketahanan energi-mineral secara berkelanjutan. Penelitian ini menyimpulkan bahwa reformulasi kebijakan hilirisasi pertimahan dalam kerangka PSN pada PT Timah Tbk merupakan langkah strategis yang tidak hanya berorientasi pada peningkatan nilai tambah ekonomi, tetapi juga pada penguatan ketahanan energi-mineral nasional secara sistematis dan berkelanjutan.

This research is motivated by the strategic position of tin (Sn) commodities in the modern energy system and the need to strengthen national energy-mineral resilience through downstreaming policies. In this context, the determination of tin downstreaming as part of the National Strategic Project (PSN) at PT Timah Tbk is an issue that requires comprehensive legal and policy studies. The problem formulation in this research includes: (1) what is the basis and urgency of determining the tin downstreaming policy as part of the PSN at PT Timah Tbk; and (2) How is the reformulation of the tin downstreaming policy within the PSN framework. A qualitative method with a literature study method (library research) and a descriptive-analytical approach. Data were obtained through a review of laws and regulations, policy documents, and scientific literature relevant to the mining, industry, and energy sectors. The analysis was conducted to examine the relationship between the tin downstreaming policy, the PSN framework, and the concept of national energy-mineral resilience.
The research results show that the determination of downstream tin processing within the PSN framework has a strong constitutional and juridical basis, specifically referring to Article 33 of the 1945 Constitution of the Republic of Indonesia as well as statutory regulations in the mining and PSN sectors. Substantively, downstream tin has strategic urgency because it can increase domestic added value, guarantee the availability of conductive materials for the energy industry, and strengthen the structure of critical mineral-based industries. In the policy aspect, the formulation of downstream tin processing needs to be directed at strengthening the upstream-downstream value chain which is integrated with the energy industry, this is because several findings are still being found, including: regulatory disharmony, licensing uncertainty, and limited supply of raw materials. Policy evaluation shows the need for reformulation that emphasizes harmonization of regulations, legal certainty, and optimization of the use of associated minerals to support sustainable energy-mineral security. This research concludes that the reformulation of the tin downstream policy within the PSN framework at PT Timah Tbk is a strategic step that is not only oriented towards increasing economic added value, but also at strengthening national energy-mineral security in a systematic and sustainable manner.
