Abstract
The distribution of Netflix original films excerpts on digital media platforms is becoming increasingly widespread which may violate Netflix's copyrights as the author and/or copyright holder. This situation highlights the urgent need for effective, structured legal protection and dispute settlement mechanisms in safeguarding such works in the digital era. This study analyzes legal protection and dispute settlement mechanisms in Indonesia and the United States, examining their implementation and the differences between the legal systems of the two countries. This study is a normative legal study employing a comparative approach. Data was collected through library research and then analyzed using a systematic interpretation of relevant legal regulations and norms. The research findings indicate that dispute settlement and protection mechanisms in the United States are considered more integrated and systematic, whereas Indonesia’s approach appears more conventional, rigid, and its copyright laws are not yet sufficiently adapted to the digital platform. There is a need to strengthen law enforcement systems such as preventive measures in both countries, implement counter-notification and platform liability limitations in Indonesia, in order to maximize the effectiveness of copyright protection for cinematographic works in the digital space.
