Abstract

Perempuan korban kekerasan sebagai salah satu kelompok rentan seringkali menghadapi berbagai kendala dalam mengakses keadilan melalui mekanisme hukum. Berbagai studi dan laporan mengungkapkan bahwa perempuan korban kekerasan berpotensi mengalami diskriminasi dan reviktimisasi ketika berhadapan dengan sistem peradilan pidana. Peranan penengah seperti Paralegal Komunitas atau Paralegal Berbasis Masyarakat dalam fungsinya sebagai pemberi bantuan hukum menjadi sangat penting untuk membantu kendala yang dihadapi perempuan korban kekerasan dalam mengakses keadilan. Tulisan ini menguraikan bagaimana strategi mengoptimalkan kedudukan dan peran Paralegal Berbasis Masyarakat dalam gerakan bantuan hukum untuk meningkatkan akses terhadap keadilan bagi perempuan korban kekerasan.
Pendekatan yang digunakan dalam penelitian ini adalah kajian sosio-legal yang dilakukan dengan studi literatur dan studi lapangan terkait pelaksanaan peran Paralegal Berbasis Masyarakat dalam pemberian bantuan hukum yang demikian berpengaruh kepada peningkatan akses terhadap keadilan bagi perempuan korban kekerasan. Analisis dilakukan secara kritikal melalui pendekatan Teori Hukum Feminis dan Teori Sistem Hukum.
Hasil penelitian menunjukkan bahwa Paralegal Berbasis Masyarakat yang bekerja dengan dan di bawah supervisi Lembaga Bantuan Hukum atau organisasi kemasyarakatan yang memberi layanan bantuan hukum, berupaya meningkatkan akses terhadap keadilan bagi perempuan korban kekerasan di komunitasnya melalui pemberian layanan bantuan hukum berspektif hak asasi manusia dan keadilan gender. Layanan bantuan hukum yang diberikan tidak hanya sebatas menyelesaikan suatu kasus hukum yang dialami oleh individu/kelompok perempuan korban kekerasan, tetapi juga merupakan upaya strategis untuk mengubah sistem hukum, yang terdiri dari substansi hukum, struktur hukum, dan budaya hukum, ke arah yang setara dan adil gender. Tulisan ini menemukan permasalahan dan tantangan pelaksanaan pemberian bantuan hukum oleh Paralegal Berbasis Masyarakat bagi perempuan korban kekerasan, termasuk bagaimana langkah strategis untuk menjawab problem faktual tersebut.

ABSTRACT

Women victims of violence, as one of the vulnerable groups, often face various obstacles in accessing justice through legal mechanisms. Various studies and reports reveal that women victims of violence have the potential to experience discrimination and re-victimization when dealing with the criminal justice system. The role of intermediaries such as Community Paralegals or Community-Based Paralegals, in their function as legal aid providers, becomes very important to help the obstacles faced by women victims of violence in accessing justice. This paper outlines how the strategy to optimize the position and role of Community-Based Paralegals in the legal aid movement to increase access to justice for women victims of violence.
This research used socio-legal method conducted with literature studies and field studies related to the implementation of the role of Community-Based Paralegals in the provision of legal assistance which has an effect on increasing access to justice for women victims of violence. The analysis was carried out critically through the approaches of Feminist Legal Theory and Legal Systems Theory.
This research showed that Community-Based Paralegals, who work with and under the supervision of the Legal Aid Organizations or community organizations that provide legal aid services, seek to improve access to justice for women victims of violence in their communities through the provision of legal aid services with the perspective of human rights and gender justice. Legal aid services are provided not only to resolve a legal case experienced by an individual or group of women victims of violence, but also are a strategic effort to change the legal system that consists of legal substance, legal structure, and legal culture in the direction of gender equality. This paper discusses the problems and challenges in implementing the provision of legal assistance by Community-Based Paralegals for women victims of violence, including how to take strategic steps to address these factual problems.
