Abstract

Fokus penelitian ini bertujuan untuk menjawab masalah perjanjian jual beli listrik Tenaga Panasbumi/PLTP yang terjadi pada masa pandemi covid-19. Pandemi covid 19 dengan segala konsekuensi hukum atas kebijakan yang dibuat oleh Pemerintah dalam membatasi aktivitas kegiatan bisnis (PPKM) memiliki implikasi secara langsung dan tidak langsung terhadap perjanjian jual beli listrik / PPA antara IPPs (Independent Power Producers) dengan PT PLN Persero sebagai para pihak dalam PPA pada PLTP. Pembangit Listrik Tenaga Panas Bumi (Geothermal) memiliki potensi yang besar untuk dikembangkan di beberapa daerah Indonesia Dengan potensi pembangkitan sebesar 28.100 MW tersebut, disayangkan bahwa pemanfaatan PLTP di Indonesia masih sangatlah kecil yaitu sekitar 1.197 MW atau 4% dari total potensi yang ada.
Metode pendekatan yang digunakan dalam penelitian ini adalah metode yuridis normative dengan jenis penelitian kualitatif dengan metode preskriptif. Data pada penelitian menggunakan data sekunder
Berdasarkan draft PPA yang menjadi objek penelitian, kondisi sulit tidak muncul dalam draft perjanjian jual beli antara PT PLN Persero sehingga hasil penelitian ini memunculkan adendum pasal mengenai kondisi sulit / hardship sehingga peneliti mengkategorikan pandemi covid 19 sebagai hardship. berdasarkan ketentuan UPICC yang tercantum dalam Pasal 6.2.2 UPICC yaitu peristiwa yang secara fundamental telah mengubah keseimbangan kontrak, sehingga ada salah satu atau keduanya tidak dapat memenuhi satu atau beberapa hak dan kewajiban sesuai kontrak yang disepakati. Pada masa Pandemi Covid-19, tercatat sumber daya panas bumi yang termanfaatkan telah mencapai 1.948,5 MW yang terdiri dari 13 Pembangkit Listrik Tenaga Panas Bumi (PLTP) pada 11 Wilayah Kerja Panas Bumi (WKP). Sebaran 13 Pembangkit Listrik Tenaga Panas Bumi (PLTP) yang terpasang berdasarkan letak geografis dari wilayah barat sampai wilayah timur Indonesia. Pada masa covid-19, semua Pembangkit Listrik Tenaga Panas Bumi melakukan Pembayaran Take or Pay dengan dilakukan Renegoisasi antara PT PLN Persero dan Perusahaan Swasta (IPP).

The focus of this research aims to answer the problem of the sale and purchase agreement for Geothermal Power/PLTP electricity that occurred during the Covid-19 pandemic. The Covid 19 pandemic with all the legal consequences for policies made by the Government in limiting business activity activities (PPKM) has direct and indirect implications for the electricity purchase agreement / PPA between IPPs (Independent Power Producers) and PT PLN Persero as parties to the PPA on PLTP. Geothermal Power Plants (Geothermal) have great potential to be developed in several regions of Indonesia. With a generation potential of 28,100 MW, it is unfortunate that the utilization of PLTP in Indonesia is still very small, namely around 1,197 MW or 4% of the total existing potential.
The approach method used in this study is a normative juridical method with a qualitative research type with a prescriptive method. Data in research using secondary data
Based on the PPA draft which was the object of research, difficult conditions did not appear in the draft sale and purchased agreement between PT PLN Persero so that the results of this study raise an addendum to the article regarding difficult conditions/difficulties so that researchers categorize the Covid 19 pandemic as a hardship. based on the UPICC provisions listed in Article 6.2.2 UPICC, namely events that have fundamentally changed the balance of the contract, so that one or both of them cannot fulfill one or several rights and obligations according to the agreed contract. During the Covid-19 Pandemic, it was recorded that 1,948.5 MW of geothermal resources had been utilized, consisting of 13 Geothermal Power Plants (PLTP) in 11 Geothermal Working Areas (WKP). Distribution of 13 Geothermal Power Plants (PLTP) installed based on geographical location from the western region to the eastern region of Indonesia. During the Covid-19 period, all Geothermal Power Plants made Take or Pay payments by renegotiating them between PT PLN Persero and Private Companies (IPP).
