Abstract

The dynamics of diplomatic relations that exist between states develop harmoniously in line with the development of the complexity of interests and needs between states. International law which is often placed as a body of legal ethics classifications is also interpreted by where the law is applied. Through the conflict events that occurred in Ukraine and Russia, at least the Diplomatic Relations that occurred between the European Union and Russia experienced destruction in the form of the the Imposition of Persona Non Grata for diplomatic representatives assigned in those states. Persona Non Grata is used as an action to send back diplomatic officials from the sending state which can occur due to various aspects, such as: violations of the Vienna Convention, violations of the law of the receiving state, acts of espionage, and political or subversive actions. The result of this research from the case study that occurred between the European Union which expelled several Russian diplomatic officials at least influenced by those elements. Nevertheless, Article 9 of the Vienna Convention on Diplomatic Relations of 1961 (VCDR) does not clearly and declaratively regulate the substance of the imposition of Persona Non Grata. Hereinafter, by exploding the act of Imposing Persona Non Grata by the European Union can also be carried out reciprocally by Russia. In other words, Persona Non Grata can be reversible and does not violate the rights of diplomatic privileges and immunity. The approach that will be used in this Legal Writing refers to normative juridical by conducting a study of the implementation of Diplomacy Law or International Law that intersect with the legal issues studied and by examining the system of norms used to provide prescriptive of ‘justification’ for a legal event thereby the goal in explain the implementation of Persona Non Grata for diplomatic officials and the embodiment of influencing elements of Persona Non Grata between the European Union and Russia can be thoroughly discussed.
